Terms of Service

These terms are an agreement between you and Warhelm Games, LLC, a Texas limited liability company ("we", "us"), about InstaSpawn: the website at instaspawn.com, our Roblox Studio plugins and other tools, and the services behind them (together, the "Services"). They are between you and us only, not Roblox. By using the Services you agree to them and to our Privacy Policy.

Some Services have extra terms that we show where you use them, for example when you buy something or turn on a feature. Those terms are part of this agreement, and for that Service they apply if the two conflict.

Who can use the Services

You must be 13 or older and allowed by Roblox, and by any other platform a Service runs on, to use it. Only an adult (18, or the age of majority where you live) can make a purchase. If you're under 18, a parent or guardian must agree to these terms for you and make any purchase for you, and is responsible for your use of the Services.

Your InstaSpawn account

You can create an account on our website. You need one to buy a plan; the free tools work without one. If you create an account, you agree to provide accurate information and to keep your login credentials secure, and not to use the password of your Roblox account or any other service. You are responsible for all activity under your account. Notify us promptly at support@instaspawn.com of any unauthorized use. Your account shows the plans you bought with it, and their codes. You can delete it at any time on your account page.

Your Roblox account

Our tools work with the Roblox account you're signed into in Roblox Studio, and you must follow Roblox's terms. Your InstaSpawn account is separate from it, and we never ask for your Roblox password. Anything you buy is for you alone, so don't share it. We may limit how many devices use a plan at once, and stop a plan on Roblox accounts that share it.

Paid plans and billing

• Some Services are paid, by subscription or one-time purchase. The price and what it includes are shown before you pay.
• Subscriptions are billed in advance and renew automatically at the end of each billing period, charging your payment method, until you cancel.
• Purchases on our website are sold by Creem, our merchant of record, which takes payment and handles taxes, receipts and refunds under its Buyer Terms. Purchases made through another platform, such as Robux purchases on Roblox, also follow that platform's terms.
• You can cancel a subscription online at any time: on your account page, or with the link in any receipt. Canceling stops future renewals, and your plan stays on until the end of the period you've paid for.
• If you delete your account, the plans on it end at once, any subscription stops, and the time left in your current period isn't refunded.
• When you buy a plan for a tool, you get a code, shown on your account page and in your email. Entering it in the tool turns the plan on for the Roblox account you're signed into there, and the tool shows you which account before you confirm. Confirming means you agree to these terms, and we record which version and when. A plan is on one Roblox account at a time. You can move it to another account from the tool, at most once every 7 days (contact us if you need it moved sooner); it turns off on the old account when it moves. A plan is for one person: it works on up to 3 computers signed into that account, and on no more than 2 of them at the same moment. If it's used on more, we may stop the extra use; if a code looks shared, we may limit it or turn it off. Keep your code private: don't share, sell or publish it.
• Every plan, Pro included, is subject to reasonable-use limits that keep the Services working for everyone. We may set or change these limits, and may slow or pause use that goes well beyond normal use of a tool like this.
• Credits and usage allowances have no cash value, can't be transferred or exchanged, and expire as stated when you get them.
• Payments are non-refundable unless the seller's policy or the law requires a refund.
• If a payment is refunded, reversed or charged back, what it paid for ends at once and we may suspend your account.
• We may change prices for future billing periods. We'll email subscribers at least 10 days before a new price applies to them, and you can cancel before it does.

Your content

"Input" is what you bring to the Services, such as models, images and prompts. "Output" is what the Services make for you from it. You keep your rights in your input. As between you and us, the output is yours, and we assign to you any rights we have in it. You let us process your input and output only to provide, secure and improve the Services, as our Privacy Policy describes. We don't keep your content longer than a Service needs, so keep your own copies. You're responsible for having the rights to your input and for what you publish.

AI features

Some Services use artificial intelligence, including models run by other companies, to generate content.

• Output is generated automatically. It may be inaccurate or unexpected, and may be similar to output made for other people, which doesn't make theirs yours or yours theirs.
• Some output may not be protected by copyright, and we don't promise that it is.
• Check output before you use it. You're responsible for how you use and publish it, including following Roblox's rules.
• We and our providers may automatically filter or refuse inputs and outputs to keep them safe and lawful.
• Don't use AI features to depict a real person without their permission, to impersonate anyone, or to copy characters, brands or art you don't have the rights to.

Our rights

We own the Services. We give you a personal, non-transferable, revocable license to use them under these terms. If you send us feedback, we may use it freely.

Acceptable use

Don't use the Services to:

• break the law or Roblox's rules,
• infringe anyone's rights, or
• make content that sexualizes minors or is otherwise harmful.

Don't:

• copy, decompile, reverse engineer or modify our software or services,
• get around their limits or payment,
• overload or disrupt them,
• use automated access we haven't enabled,
• use the Services or their output to build a competing product or train AI models, or
• resell or share access.

You may not use the Services if you are in a country under US sanctions or on a US sanctions list.

Changes, suspension and ending

We may change, add or remove features or Services, or stop offering them. If we stop offering a subscription, we'll give 30 days' notice and stop renewals. We may suspend or end your access if you break these terms, if your use creates legal or security risk, or if the law requires it. You can stop using the Services and cancel at any time. Terms that by their nature should survive will continue after your access ends.

Roblox and other services

The Services rely on Roblox, Roblox Studio and other services we don't control, including AI providers, and we aren't responsible for them or their changes. InstaSpawn is not affiliated with, endorsed by or sponsored by Roblox Corporation, and Roblox isn't responsible for the Services. Roblox and Roblox Studio are trademarks of Roblox Corporation. Other names and logos we mention, such as Meshy, Tripo, Rodin/Hyper3D, Hunyuan3D, Blender and Sketchfab, belong to their owners, and none of them is affiliated with, sponsors or endorses InstaSpawn. Blender is a registered trademark of the Blender Foundation.

When you use our tools in Roblox Studio or with your Roblox account, you must also follow Roblox's Terms of Use and its other rules. This agreement is between you and Warhelm Games, LLC only. Roblox isn't a party to it, isn't responsible for InstaSpawn or what it does, and has no duty to maintain or support it. You release Roblox Corporation from any claims about InstaSpawn, including claims that it doesn't work, doesn't meet a legal or regulatory requirement, or harms you or your work. Questions, complaints and claims about InstaSpawn come to us, not to Roblox.

Disclaimers

The Services and all output are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services will be uninterrupted or error-free, or that results will suit your project. We aren't responsible for failures caused by events beyond our reasonable control.

Limitation of liability

To the fullest extent the law allows:

• we aren't liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, and
• our total liability for all claims is limited to what you paid for the Services in the 12 months before the claim arose.

Indemnification

You agree to indemnify and hold harmless Warhelm Games, LLC and its affiliates from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your content, your use of output, your misuse of the Services, or your violation of these terms or the law.

Your legal rights

Nothing in these terms limits rights you have under consumer law that can't be waived, or any liability the law doesn't allow to be limited.

Disputes

If you have a problem, email legal@instaspawn.com first and give us a chance to put it right. These terms are governed by the laws of the State of Kansas, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Kansas will have jurisdiction over any disputes, except where applicable law gives you the right to bring a claim elsewhere.

Changes to these terms

We may update these terms and will change the date above. For material changes, we'll give notice in our tools or on the website (and subscribers by email) before they take effect. Continuing to use the Services after that means you accept them. Changes don't apply to disputes that arose earlier.

General

These terms, any extra terms for a Service, and our Privacy Policy are the whole agreement between us about the Services. If part of them is unenforceable, the rest still applies. If we don't enforce a term, we haven't waived it. You can't transfer these terms; we may transfer them along with our business.
